Pattern Fold Agency Pvt. Ltd. is a technology and digital growth company providing Web Development, App Development, AI Development, SaaS Development, Custom Software Development, Automation Tools, CRM and ERP Development, UI/UX Design, Digital Marketing, Performance Marketing, SEO, Brand Identity, Graphic Designing, Video Editing, and related digital solutions.
The Pattern Fold Agency website may be visited by anyone. Visitors and clients must use the website lawfully and responsibly. Unauthorized access, hacking, malicious activity, fraud, abuse, spam, malware, phishing, unlawful content, or activity intended to disrupt, damage, misuse, or gain unauthorized access to our website or systems is prohibited. Pattern Fold Agency may restrict access, suspend services, preserve relevant information, and cooperate with competent authorities where required by applicable law.
Clients may review our services and submit project requirements through our website. A project is undertaken based on the scope, features, requirements, pricing, timeline, and other terms communicated or agreed with the client. Any project-specific quotation, invoice, proposal, or written agreement may form part of the applicable service terms.
The standard project process requires a 20% advance payment, unless a different payment structure has been mutually agreed in writing. Work may begin after the required advance payment and project information have been received. The advance payment is subject to our separate Refund & Cancellation Policy.
Unless otherwise agreed in writing, the remaining project payment must be cleared before the domain is connected to the completed website/project. Applicable invoices and payment information may be available through the client's customer panel. Failure to make required payments may result in suspension or permanent closure of the applicable website/service.
Once work has started, new features, additional pages, integrations, major design changes, functionality, or requirements outside the agreed scope may be treated as additional work. The client is responsible for the applicable additional cost and any additional time required. Previously paid amounts do not automatically become refundable because the scope is changed.
The client is responsible for providing accurate information, business details, content, images, logos, credentials, access, approvals, API information, and other materials reasonably required for the project. The client may provide their own materials. Where the client requests Pattern Fold Agency to create or source additional materials, applicable charges may apply.
Where a client delays required content, information, approvals, access, credentials, payments, or other dependencies, the project delivery timeline may be extended accordingly. Such client-side delays do not create an automatic right to a refund.
Projects include a reasonable number of revisions based on the agreed scope. Minor revisions to content, layout, imagery, or originally agreed requirements may be included. Major redesigns, new functionality, additional pages, or changes to an approved direction may be treated as additional work and may incur additional charges. Revision limits may also be specified in the project quotation or agreement.
Unless otherwise agreed in writing, final deliverables are provided according to the agreed scope and payment terms. Source code is not automatically included in standard project delivery. If a client requires source code, source-code access or transfer may be provided subject to a separate fee and written agreement. Third-party themes, plugins, APIs, libraries, fonts, stock assets, software, and licenses remain subject to their respective owners' terms.
Unless a client has specifically agreed otherwise in writing, Pattern Fold Agency may showcase completed projects, designs, screenshots, or general project information in its portfolio, website, social media, presentations, or case studies for promotional and professional purposes, subject to applicable confidentiality obligations.
Projects may depend on third-party services such as domains, hosting providers, cloud platforms, APIs, payment gateways, plugins, software licenses, Meta, Google, communication platforms, analytics tools, or other external services. Pattern Fold Agency does not control third-party availability, pricing, policies, technical changes, outages, suspensions, or discontinuation and is not responsible for failures solely caused by such third parties.
Pattern Fold Agency may use or integrate third-party AI services and APIs. Their availability, pricing, limitations, outputs, policies, and continued operation depend on their respective providers. AI-generated information or outputs may require human review and validation, particularly for important business, legal, financial, medical, or other high-impact decisions.
Digital marketing and performance marketing services may include SEO, Meta Ads, Google Ads, social media, creative strategy, campaign management, and related services. Performance can be affected by budget, competition, market conditions, product or service quality, customer behaviour, advertising policies, platform algorithms, tracking limitations, and other factors outside the agency's direct control.
The client is responsible for ensuring that content, images, videos, music, trademarks, documents, data, products, services, claims, and other materials supplied or published for the client's project are lawful and properly authorized. Any unlawful, infringing, misleading, fraudulent, or unauthorized content supplied or instructed by the client remains the client's responsibility. Pattern Fold Agency may suspend or refuse publication of content that reasonably appears unlawful or harmful.
Both parties should use reasonable care to protect confidential business, technical, financial, strategic, customer, and project information received from the other party. Confidential information should not be disclosed to unauthorized persons except where required by law, necessary for agreed service delivery, or otherwise authorized.
Unless otherwise stated in the project agreement, Pattern Fold Agency provides one year of guidance and technical support following project delivery. This support is for assistance and guidance and does not include unlimited changes, redesigns, new features, content updates, or ongoing maintenance. Such work may be separately chargeable.
If a genuine technical issue is found in an agreed functionality delivered by Pattern Fold Agency, the agency will review and, where the issue is attributable to the delivered work, make reasonable efforts to fix it. A new feature, change of requirement, redesign, third-party change, client modification, or newly requested functionality is not considered a bug and may be chargeable.
Pattern Fold Agency may suspend or terminate services where a client fails to make required payments, engages in fraudulent or unlawful activity, attempts unauthorized access, materially breaches these Terms, misuses agency systems or services, or repeatedly fails to cooperate with project requirements. Suspension or termination does not automatically create a refund entitlement and remains subject to the Refund & Cancellation Policy.
Clients must not use services or delivered platforms for unlawful activities, fraud, malware distribution, phishing, hacking, unauthorized access, spam, copyright infringement, or other prohibited activities. The client is responsible for the legality, ownership, accuracy, and permitted use of content, data, products, services, and activities conducted through the client's website or digital platform. Pattern Fold Agency may take appropriate action and cooperate with competent authorities where required by applicable law.
To the extent permitted by applicable law, Pattern Fold Agency will not be responsible for indirect, incidental, special, consequential, or business losses arising from third-party outages, platform changes, client-provided content, unauthorized client activities, loss of business opportunity, or circumstances outside the agency's reasonable control. Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded.
No guarantee is made that external services, APIs, hosting environments, advertising platforms, payment gateways, or other third-party systems will remain available, unchanged, uninterrupted, or error-free.
Refunds, cancellations, advance payments, and applicable exceptions are governed by the Pattern Fold Agency Refund & Cancellation Policy. Project-specific written agreements may also contain additional applicable terms.
Collection and handling of personal information through the Pattern Fold Agency website and services are governed by our separate Privacy Policy. Users should review the Privacy Policy to understand applicable data practices.
Circumstances outside reasonable control, including natural disasters, war, government restrictions, major infrastructure failures, or widespread internet/cloud outages, may affect service delivery and timelines. Specific cancellation and refund rights remain subject to the applicable project terms and Refund & Cancellation Policy.
Pattern Fold Agency Pvt. Ltd. may update these Terms & Conditions from time to time. Updated terms may be published on the website with a revised effective or last-updated date.
These Terms & Conditions are intended to be governed by the applicable laws of India. Any dispute will be subject to the jurisdiction of competent courts and authorities having jurisdiction over the applicable matter and parties, subject to applicable law.
